NYPD officers seen in video repeatedly punching a man are placed on modified duty

Multiple officers who were involved in the arrest of a man in Brooklyn have been placed on “modified assignment,” New York Mayor Eric Adams said, after they were filmed repeatedly punching the man.

Asked why the officers used such force, Adams, a retired NYPD captain, responded in part: “Adrenaline is real.”

A video posted to social media shows at least two officers punching the man while onlookers yell and try to intervene. One of the officers takes out a Taser and keeps the bystanders at bay while two other officers struggle with the man in between two parked vehicles. At one point, the man appears to swing at one of the officers.

A New York Police Department spokesperson said that at about 9:34 p.m. on July 4, officers tried to stop a person from lighting fireworks and pointing them at apartment windows. According to police, the person fled and a 27-year-old man whom they identified as Shaquan Davis prevented police from pursuing the person by stepping in their path and pushing an officer. When the officer attempted to arrest Davis, police allege, he resisted arrest by “pushing, shoving, wrestling, flailing his arms and punching the officer.”

Davis, who lives in Brooklyn, was arrested on charges of assault of a police officer, resisting arrest, obstructing governmental administration, assault with intent to cause physical injury, disorderly conduct and harassment. He is due in court on Oct. 7. His attorney, Jonathan Fink, said Davis was released on his own recognizance and denies any wrongdoing. His position is that he was assaulted by police, Fink said.

A spokesperson for Adams referred NBC News to remarks he made on a radio show Wednesday morning.

When asked about the video by radio host Tarsha “Miss Jones” Jones of 94.7 The Block’s “Jonesy in the Morning,” Adams said he had seen it and that Police Commissioner Edward Caban had “immediately placed” the officers on a modified assignment. A modified assignment typically means an officer has been stripped of their firearm and assigned to a nonenforcement role.

“They’re going to do a thorough investigation and find out what happened,” Adams said. “Everyone must be held accountable, because when you have the power and authority to take away someone’s freedom, there’s a lot of obligation and oversight that should come with that, and I have a lot of faith in Commissioner Caban because he came up through the ranks, and his dad was a strong advocate for diversity in the Police Department.”

He added: “We’re going to look into this, and it’s going to be investigated appropriately, and if those officers are found to have done something improper, they’re going to be held accountable. We do not play the game. We’re going to support our police, but our police must support the people that they are policing.”

Jones asked him why, if police knew they were being recorded by bystanders, they felt “so comfortable” and “so empowered” to act as they did.

“That’s a great question, and I think it’s a combination of things. Adrenaline is real, people are caught up in the adrenaline, and that’s what we’re constantly trying to train people that you’ve got to take a step back,” Adams said. “You get caught up in the emotion of policing and you start just reacting and not thinking and you make those errors and mistakes.”

The police department also faced criticism this week over a five-second video posted to X by a city councilman on Tuesday that showed an officer punching a man in the face while his hands were behind him and apparently restrained.

That video was recorded in Brooklyn. A police spokesperson said a man was stopped “in regard to an amplified sound from a portable speaker” at approximately 3:42 a.m. Friday. He was warned multiple times to turn off the speaker and did not comply, according to police. When officers confiscated the speaker, he became disorderly, stepped in front of them and attempted to grab it from them, police said. According to police, officers gave him multiple warnings to remain on the sidewalk and to stop interfering with police, and when they tried to arrest him, he resisted. The man in the video, Lamark Wyche, 44, of Brooklyn, was arrested on charges of obstructing governmental administration and unreasonable noise, which Wyche said have been dropped. His attorney did not immediately return requests for comment.

The NYPD did not identify the officers in either video.

“Residents and community leaders in Coney have worked very hard over many years to build up trust and respect between the cops and the community,” said Justin Brannan, the councilman who shared the video on X. “Our community is pro-public safety. Punching people in the face when their hands are behind their backs isn’t public safety and being anti-police brutality doesn’t mean you are anti-cop. Incidents like this have a ripple effect and set everything back.”

A City Hall spokesperson said: “We hold the men and women of the NYPD to the highest standards, and we are reviewing the incident.”

Judge Aileen Cannon’s stunning ruling dismissing the federal indictment against Donald Trump for mishandling classified documents is just wrong as a matter of constitutional law, but it can be easily overcome.

Cannon held that it is unconstitutional to have a special counsel appointed by the attorney general to handle a prosecution unless there is a specific law authorizing it. The simple solution is for Atty. Gen. Merrick Garland to treat the classified documents case as a crime like any other, one that doesn’t require a special counsel. He can direct a United States attorney to immediately refile the case in federal court, and under Cannon’s reasoning there would be no constitutional problems.

The judge presiding over the case has dismissed the prosecution because of concerns over the appointment of Jack Smith, the prosecutor who brought the case.

From the outset, Cannon, who was appointed to the federal district court bench by Trump, has handled the case in a way that seemed designed to protect him. For example, earlier she ruled that a higher standard had to be met to justify a search warrant for a former president. The federal court of appeals reversed this and said that the same standards apply under the 4th Amendment to everyone.

In addition to saying that that the attorney general cannot appoint a special counsel and protect the counsel from removal, Judge Cannon also said that it is impermissible for the Department of Justice to fund a special counsel on an ongoing basis.

Judge Cannon’s decision on Monday is flat-out wrong because it is inconsistent with U.S. Supreme Court precedents and the rulings of many other courts.

The Supreme Court’s conservatives are likely to agree with the judge’s ruling in dismissing Trump’s special prosecutor

The crucial problem is that under Article II of the Constitution, the attorney general, like all Cabinet officials, can appoint “inferior officers” and can provide funding for them. Statutes give each Cabinet head broad authority to make these appointments.

The Supreme Court said all this explicitly in United States vs. Nixon in 1974. A unanimous Supreme Court declared, “Congress has also vested in [the attorney general] the power to appoint subordinate officers to assist him in the discharge of his duties.” The court explicitly held that the attorney general could appoint a special prosecutor to investigate offenses arising out of the 1972 presidential election and allegations involving President Nixon.

Cannon said that this was just “dicta” from the Supreme Court, language unnecessary to its holding, and that she was not bound by it. Quite the contrary, if the Supreme Court had come to Cannon’s conclusion, it would have had to dismiss the case before it.

The United States Court of Appeals for the District of Columbia repeatedly has addressed this issue and come to exactly the opposite conclusion as Cannon.

In 1987, there was a constitutional challenge to the special counsel investigating the Iran-Contra scandal during the Reagan administration. The federal court of appeals said: “We have no difficulty concluding that the Attorney General possessed the statutory authority to create the Office of Independent Counsel: Iran/Contra and to convey to it the ‘investigative and prosecutorial functions and powers’ described in ... the regulation. ... While [the specific statutes] do not explicitly authorize the Attorney General to create an Office of Independent Counsel virtually free of ongoing supervision, we read them as accommodating the delegation at issue here.”

In 2019, much the same challenge was brought to special counsel Robert S. Mueller III’s investigation of Russian interference in the 2016 presidential election. Once more, the federal court of appeals said the attorney general had the authority to make and fund the appointment. And just last year, a federal court rejected the same constitutional challenge to the special counsel who was prosecuting Hunter Biden. Cannon’s ruling just says she thinks these courts were wrong.

Cannon also contends that the Justice Department cannot fund a special counsel on an ongoing basis. Every department has discretion over a good deal of its budget. In fact, just this past term, the Supreme Court upheld the constitutionality of the Consumer Protection Financial Bureau and stressed the flexibility the Constitution provides in providing funding to federal activities.

What makes Cannon’s ruling dangerous is that it would eliminate a crucial tool to allow Justice Department prosecutions that have independence, and the appearance of independence, from political control, given that the attorney general is a presidential appointee.

After Watergate, Congress passed the Ethics in Government Act to create special prosecutors who could be removed only for cause and who were completely independent of the attorney general. The Supreme Court, in 1988, upheld the constitutionality of this statute. But after several lengthy investigations, including the Whitewater investigation of President Clinton, the act was allowed to lapse and was not renewed.

A new mechanism was created to allow independent investigations but with more accountability. The attorney general appoints special counsels and by internal Justice Department regulations assures them of independence. This provides public confidence in the investigation that would be lacking without that independence, which is particularly desirable when the person being investigated is a president or former president or one of their family members or a high-level government official. Because of the Article II powers, this mechanism, as much as the earlier law, is constitutional.

Special counsel Jack Smith could appeal Judge Cannon’s ruling to the United States Court of Appeals for the 11th Circuit. But that process will take months and it would ultimately likely go to the Supreme Court. The expeditious solution for this case is for Atty. Gen. Garland to have the Justice Department, through a U. S. attorney, refile the indictment against Trump. This would bypass Cannon’s problems with the special counsel.

Trump rally shooter Thomas Matthew Crooks appears to have acted as a lone wolf using an AR-style rifle that was purchased by his father, according to FBI officials.

In a call with reporters Sunday afternoon, FBI officials indicated they are still searching for a motive in the attack . The agency is acting as the lead federal law enforcement agency in the investigation of the shooting at Trump's Saturday evening Pennsylvania political rally.

"At present, we have not identified an ideology associated with the subject," said Kevin Rojek, a special agent in charge of the FBI's Pittsburgh field office. "At this time, the information that we have indicates that the shooter acted alone and that there are currently no public safety concerns."

Gunman used AR-style rifle purchased by father

Crooks used a legally-purchased "AR-style 556 rifle," according to Rojek, referring to a rifle that uses ammunition with a 5.56 mm diameter. Rojek said the weapon was located next to Crooks on the scene.

Another official on the call, who didn't identify himself when he spoke up about who purchased the weapon, said the FBI believes the weapon was bought by the shooter's father. Crooks was 20 years-old. He was shot to death by the Secret Service after the attack.

"We do not know specifically how he accessed the weapon and whether he took it without his father's knowledge," the official said.

Rojek said law enforcement is sending the rifle as well as Crooks' cell phone and other evidence, to the FBI lab in Quantico, Virginia "for processing and exploitation."

"We're in the process of searching his phone," Rojek said.

'Suspicious device' from car inspected by bomb technicians

Law enforcement also located "a suspicious device" when they searched the shooter's vehicle, according to Rojek. Bomb technicians inspected the device and rendered it safe.

He said law enforcement have now transported the device to the FBI lab in Quantico, Virginia for further analysis.

"I'm not in a position to provide any expertise on the specific components of any potential bombs or suspicious packages," Rojek added.

Investigation into possible domestic terrorism

The FBI is investigating the attack not just as an assassination attempt, but also as a potential act of domestic terrorism, according to Robert Wells, assistant director of the bureau's counterterrorism division. As a result, counterterrorism and criminal division investigators are working together to determine Crooks' motive.

"Our number one goal here is to identify the motive of the subject and determine whether he had any other associates or anyone else that was involved," Wells said.

So far, it appears Crooks was "a lone actor," according to Wells.

Brewers Designated Former Houston Astros Ace for Assignment

Dallas Keuchel, the former Houston Astros ace who won the 2015 Cy Young award, was designated for assignment by the Milwaukee Brewers on Sunday, putting him a position to hit free agency once again.

The move was posted to the MLB transactions log .

The 36-year-old left-hander can now be claimed by another team off waivers, or the Brewers can trade him to another team. If he clears waivers, the Brewers can re-sign him to a minor-league deal or Keuchel can opt to be a free agent.

The Brewers acquired Keuchel from the Seattle Mariners on June 25 in a cash trade. He had signed a minor-league deal with the Mariners in April and in May, the second time after Seattle released him.

Milwaukee was in need of a spot starter due to injuries and Keuchel fit in with four starts, during which he did not figure in a decision. In 16.2 innings he struck out 11 and walked eight while batters hit .329 against him.

His last start with the Brewers against Washington on Saturday saw him allow three earned runs on eight hits in three innings.

It’s been a rough run for Keuchel since he left Atlanta after the 2019 season to sign a three-year, $55 million deal with the Chicago White Sox. While he went 6-2 with a 1.99 ERA in the pandemic-shortened 2020 season, he followed that with a 9-9 2021 with a 5..28 ERA as he struggled with a back injury.

He didn’t finish the 2022 season with Chicago as the White Sox designated him for assignment after he had a 7.88 ERA in eight starts.

From there, Keuchel bounced around, signing with Arizona, Texas, Minnesota, Seattle and Milwaukee on minor-league deals. He’s never re-captured the form that he had in Houston, as he’s pitched in just 20 games since leaving the White Sox.

Keuchel broke in with Houston in 2012 after he was selected by the Astros in the seventh round of the 2009 MLB Draft out of Arkansas.

Once he reached the Majors, he quickly became an integral part of the Astros’ rebuild, which led to its first World Series title in 2017.

His Cy Young season in 2015 saw him go 20-8 for Houston with a 2.48 ERA, as he led the American League win in wins, shutouts, innings pitched and WHIP. He also struck out 216. He also finished fifth in AL MVP voting.

With Houston he went 76-63 with a 3.66 ERA. The two-time All-Star and five-time Gold Glove winner has a career record of 103-92 with a 4.04 ERA.
