It’s exciting when you finally get to adjust your status with the United States Citizenship and Immigration Services (USCIS). But don’t be so elated that you end up putting together an incomplete Form I-485 adjustment of status application package.

In order to effectively adjust an immigration status in the United States, foreign nationals need to complete a Form I-485 and send it in to the USCIS with evidence/supporting documents. One way to make sure that the USCIS clearly know your application purpose and sees all of the items enclosed in your I-485 AOS package is to identify them in a cover letter.

Prepare a personalized I-485 cover letter

I-485 application can be filed based on family immigrant category, employment immigrant category, and other special immigrant category. The initial evidence for each category has some discrepancy. Therefore, cover letters for these categories of I-485 applications are different from each other. Actually, applicant’s own situation will also make the cover letter different. For example, if an applicant has ever been charged of criminal violation, his or her I-485 cover letter should include a certified copy of court judgment.

In practice, some applicants will concurrently file Form I-130 or I-140 immigrant petition with their Form I-485 application, or file Form I-765 application for employment authorization and/or Form I-131 application for Advance Parole together with their Form I-485 application. Apparently, more supporting evidence needed to be filed in a concurrent filing. As a result, a cover letter for concurrent filing is more complex.

  • d) makes life easier for your busy examiner. The letter should be clear, concise, and easy to read. The letter should also be free of errors.

In this comprehensive guide, we will cover everything you need to know about writing an effective I-485 cover letter for an extraordinary ability green card application. We will discuss the purpose of the cover letter, what to include in the letter, and how to format the letter. We will also provide examples of effective cover letters.

Is an I-485 Cover Letter Important?

While an I-485 Adjustment of Status (AOS) cover letter is not required, we believe it was a powerful tool in our green card application. It shows the USCIS officer that you care by having put time and effort into preparing a complete and thorough application package and so respect their time.

As an introduction to your case the letter should provide a brief overview of your qualifications and why you are eligible for an extraordinary ability green card. The letter should also explain any discrepancies or unusual circumstances in your application.

When to file your I-485 Cover Letter

WARNING: The I-485 should only be submitted if your [“priority date” is “current”(this is only usually an issue for applicants from India and China)].

WARNING: Do not submit the I-485 if you intend to travel abroad as doing so without [Permission to Travel] can be seen as “abandoning your green card application”. In our [Permission to Travel] article we show how you can get a temporary travel papers and avoid losing your green card before you even receive it. We cover this further in our “Concurrent Filing” article.

This formal letter should explain to the first person that opens your application that you have been approved your I-140 and are adjusting your status (AOS) OR that you have filed your I-140 and are [concurrently filing] to adjust your status . EB-1 visa applicants on a valid underlying visa are permitted to file an [ Adjustment of Status ]. This has many benefits including [Temporary Work Papers] and [Permission to Travel].

When filing your I-485 forms you should this cover letter on top of your visa packet. (Visa packet just means all your forms and documents that relate to your I-485). If you are concurrently filing the I-140 section and I-485 should be separated as they can go to different departments within the USCIS.

Purpose of the I-485 Cover Letter

At a quick glance your officer:

  • understands why you are submitting your I-485 – I-140 Approval or Concurrently Filing
  • check that you have included the correct documents
  • check that you have included ALL the documents
  • can identify if your package requires a more senior officer or special consideration

How to Write the I-485 Cover Letter

Keep this letter as logical, methodical and short as possible. When writing an I-485 cover letter, there are several key components you should include:

1. Introduction

Your introduction should be brief and to the point. Begin by introducing yourself and stating that you have either an approved I-140 and are adjusting your status OR that you have filed your I-140 and are [ concurrently filing ] to adjust your status. You can include a sentence or two about your background or qualifications but it is not necessary – your officer is short on time. Place your USCIS [receipt number] or an [Alien number] up top – if you don’t have either add your US SSN (Social Security Number). If this is your first visa application be sure to add your Full Name and Date of Birth MM/DD/YYY. This number/information should be on loose pages of your application so your evidence can be easily added back to your case file. Mention the fee check included.

2. Explanation of Package Contents

In the next section of your cover letter, explain the contents of your application package. This should include a list of all the documents you are submitting, along with a brief description of each document. Make sure to organize your list in a clear and easy-to-read format.

If concurrently filing it should also tell them here that you are submitting your I-140 with petition letter and evidence, and/or, you are also applying for adjustment of status(I-485). It should also list the important documents enclosed in your packet.

Below is a list of documents that may be submitted this list might not be relevant to you.

3. Explanation of Discrepancies or Unique Circumstances

It is unusual for applicants to need to mention anything here, however, here’s your opportunity if necessary. If there are any discrepancies or unique circumstances in your application, your cover letter is the place to explain them. Be honest and transparent about any issues that may arise in your application, and provide any necessary documentation to support your explanation. This can be related to your criminal past etc. If you have consulted an immigration attorney or other professional, you can mention this in your cover letter as well.

4. Conclusion

In the conclusion of your cover letter, thank the USCIS officer for their time and consideration. You can include a sentence or two about why you believe you are a strong candidate for a green card and why you are excited to become a permanent resident of the United States but we believe this is not necessary and a waste of the USCIS officers time.

What Is a USCIS Cover Letter?

You may also use a cover letter to explain any special circumstances you want the USCIS officer to be aware of before they start reviewing your application. If you have a unique or complicated background, it is especially helpful to supplement your application with a cover letter. It will ensure that USCIS becomes aware of any special circumstances and can consider your application with this in mind.

Is a Cover Letter Required for My USCIS Application?

USCIS does not require you to submit a cover letter for any immigration benefit or visa application. Many immigration attorneys include cover letters for their clients to prevent any misunderstandings or missing paperwork. Immigration officers read through a lot of paperwork, so any guidance or organization you can offer them will be helpful. 

Cover letters may be especially helpful when you are in a unique situation. What Should My USCIS Cover Letter Include?

When submitting a cover letter with your application, be sure to include the following:

The USCIS filing location or lockbox address to which you’re sending your application

The date of filing

An appropriate subject (re:) line

A short introductory paragraph to describe the contents of your letter and package

If applying for a marriage-related benefit, information about the marriage date and location for yourself (the beneficiary) and your spouse (the petitioner)

An ordered list of the content in your application package, including all supporting documents and filing or biometrics fees included

A closing paragraph including your contact information

Your signature and full printed name

Your supporting documents for an application will depend on which forms you’re filing. You can determine which documents are necessary by reviewing USCIS’ webpage for your specific form. For example, USCIS lists the required supporting evidence on its webpage for Form N-400 applicants.

You’ll also need to identify the right mailing address for your application. To do so, you should consult the USCIS website. For example, naturalization applicants can review USCIS’s webpage for Form N-400 direct filing addresses .

Your filing fees will depend on your specific application type. You can use the USCIS Fee Calculator to determine your costs. For example, suppose you are filing for naturalization with Form N-400. You should select Form N-400 on the Fee Calculator and enter your age. USCIS may ask for additional information, such as your specific application category.

Tips for Writing Your USCIS Cover Letter

When writing a USCIS cover letter, be sure to type your letter in English on a computer. Keep your letter concise and only include necessary information. A long cover letter will not be as helpful to a USCIS officer as a brief letter. If possible, keep your letter to one page. Yes, most Green Card related filings require passport-style photos, or they are highly recommended. When in doubt, add them to the filing.

Are Copies of Documents ok?

Yes, copies of all documents are acceptable, as long as the copy is a nice color scan. The only time to provide original documents is when they are specifically requested by USCIS, and when submitting Certified Copies of Court, Police, and Prison Records.

I-485, Application to Register Permanent Residence or Adjust Status

Alert: USCIS has prioritized employment-based adjustment of status applications during every step of its processing and adjudication during this fiscal year.  We continue to make processing and resource allocation decisions to increase the pace of adjudications and limit the potential for employment-based visa numbers to go unused.  If you are applying for a Green Card in an employment-based category and we issued you a Request for Evidence (RFE) for your Form I-693, Report of Medical Examination and Vaccination Record , you should respond as soon as possible so we can finalize a decision on your adjustment application.  

ALERT: If you are concurrently filing a Form I-140 and Form I-485, do not combine your supporting documents. Clearly separate each package using fasteners or heavy clips to hold together each set. We recommend assembling each form package in the following order:

  • Check or money order or  Form G-1450, Authorization for Credit Card Transactions ;
  • Form G-1145, Request for e-Notification  (if applicable);
  • Form G-28  (if applicable);
  • The form you are filing; and
  • Supporting documentation.

ALERT: Effective April 4, 2024, any Form I-693 that was properly completed and signed by a civil surgeon on or after Nov. 1, 2023, does not expire, and can be used indefinitely as evidence to show that the applicant is not inadmissible on health-related grounds.   • Submit your Form I-693, Report of Immigration Medical Examination and Vaccination Record, at the same time you file your Form I-485;
  • File all required initial evidence and supporting documentation as described in the form instructions. You may use the Checklist of Required Initial Evidence as an optional resource; and
  • Use the current edition for Form I-485.

Submitting all required initial evidence and supporting documentation at the same time you file Form I-485 may eliminate the need for us to issue a Request for Evidence (RFE) to obtain additional evidence and documentation, which may further delay adjudication of your case.

If you are required to submit a Form I-693, we cannot approve your Form I-485 without your Form I-693. We generally consider a completed Form I-693 to remain valid for two years after the date the civil surgeon signed it.

Use this form to apply for lawful permanent resident status if you are in the United States.

If you file at a USCIS lockbox, you may not receive an A-Number on your Form I-797, Notice of Action, due to a change in our business process. In these cases, we will send your A-Number in a second notice a few days after accepting your application.

In general, you may not file your Form I-485 until a visa is available in your category. For information on the process of adjusting status as a permanent resident, and how to determine whether and when you are eligible to adjust status and file Form I-485, see our Visa Availability and Priority Dates and Adjustment of Status Filing Charts from the Visa Bulletin pages. You can pay the fee with a money order, personal check, cashier's check, or  pay by credit card  or debit card using  Form G-1450, Authorization for Credit Card Transactions . If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

When you send a payment, you agree to pay for a government service. Filing fees are final and non-refundable, regardless of any action we take on your application, petition, or request, or if you withdraw your request.  If you pay by credit card or debit card, you cannot later dispute the payment. If you are submitting multiple forms, pay each filing fee separately. We are transitioning to electronically processing immigration benefit requests, which requires us to use multiple systems to process your package. We may reject your entire package if you submit a single, combined payment for multiple forms.

Save time by submitting all required initial evidence and supporting documentation at the same time you file Form I-485.

The checklist is an optional tool to use as you prepare your form, but does not replace statutory, regulatory, and form instruction requirements. Submitting all required initial evidence and supporting documentation at the same time you file Form I-485 may eliminate the need for us to issue a Request for Evidence to obtain additional documentation and evidence. This may also help avoid adjudication delays if we decide that you do not need to be interviewed.

You may also save time by submitting Form I-693, Report of Immigration Medical Examination and Vaccination Record, with your Form I-485. We generally consider a completed Form I-693 to remain valid for two years after the date the civil surgeon signed it.

E-Notification : If you want to receive an e-mail and/or text message that we have accepted your form at a USCIS lockbox, complete Form G-1145, E-Notification of Application/Petition Acceptance , and clip it to the first page of your form.

Effective July 20, 2022, we transitioned the responsibility to adjudicate Special Immigrant Visa (SIV) petitions filed by Afghans to the U.S. Department of State (DOS). Afghans who start the SIV application process on or after July 20, 2022, may seek classification as a special immigrant with DOS by filing Form DS-157 with the application for Chief of Mission approval. For more information, see instructions on the DOS website on Special Immigrant Visas for Afghans – Who Were Employed by/on Behalf of the U.S. Government .

When filing Form I-485, you must supply evidence of an approved Form I-360 or a copy of the COM approval letter that also indicates approval of your Form DS-157 . INA 245(i)

Filing I-485 Supplement J

If you are filing Form I-485 together with a Form I-140 that names you as the principal beneficiary, you do not need to file Supplement J.

However, you must file Supplement J if you are filing Form I-485 based on a previously filed Form I-140 or if you are requesting job portability to a new, permanent job offer under INA section 204(j). Filing Form I-765 and Form I-131 with Form I-485

If you submitted Form I-485 on or after July 30, 2007, and before April 1, 2024, and paid the required fee, you do not have to pay an additional fee to also file Form I-765, Application for Employment Authorization , and/or Form I-131, Application for Travel Document . However, if you file Form I-485 after April 1, 2024, you must pay additional fees to file Form I-765 or Form I-131, as listed on our Fee Schedule page. In either case, you may submit these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, (also known as your receipt) as evidence that you filed Form I-485. 

Which Box to Check in Part 2 of Form I-485

Before filing a Form I-485 based on a family-sponsored or employment-based preference category, check our Visa Bulletin page to see if your priority date makes you eligible to apply. 

If you are the principal applicant, check the appropriate box in  Part 2, Item 1.,  of Form I-485 and check the appropriate box in  Part 2, Item 2.a.  through  8.e.

If you are the derivative spouse or child of the principal applicant, check the appropriate box in  Part 2, Item 1.,  of Form I-485 and check the appropriate box in  Part 2, Item 2.a.  through  8.e.

Premium Processing

You may file Form I-485 and Form I-140 together at the USCIS Dallas Lockbox.

If you are requesting premium processing for Form I-140, you must also file  Form I-907, Request for Premium Processing Service . Refer to our  Direct Filing Addresses for Form I-140, Immigrant Petition for Alien Workers , page if you want to file Forms I-485, I-140, and I-907 together. Do NOT file Form I-907 at a USCIS lockbox.

Read the Employment-Based Preferences chart in the  Department of State’s Visa Bulletin  page to ensure your priority date is current before you file your application.

Afghan Parolees

If you are an Afghan parolee with an approved Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant , as an Afghan employed by or on behalf of the U.S. government or International Security Assistance Force (ISAF) in Afghanistan, or an approved Form DS-157, Petition for Special Immigrant Classification for Afghan SIV Applicants, and you did not complete Form I-485, Application to Register Permanent Residence or Adjust Status , we encourage you to file Form I-485 as soon as possible to apply to become a lawful permanent resident and get a Green Card if eligible.

If you are an Afghan parolee with an approved Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant , as an Afghan employed by or on behalf of the U.S. government or International Security Assistance Force (ISAF) in Afghanistan, and you did not complete Form I-485, Application to Register Permanent Residence or Adjust Status , at a safe haven, we encourage you to file Form I-485 as soon as possible to apply to become a lawful permanent resident and get a Green Card. You must provide a U.S. address to file Form I-485. If your address changes, you must notify us of your new address within 10 days by submitting Form AR-11, Alien’s Change of Address Card. The fastest way to submit your Form AR-11 is online . Special filing instructions apply to those filing Form I-485 in this category. You do not have to pay the filing or biometric services fees for Form I-485 if you were paroled into the United States due to the humanitarian crisis and are applying for adjustment as an Afghan Special Immigrant.

When filing Form I-485, include evidence of an approved Form I-360 petition or a copy of the Chief of Mission approval letter which also indicates approval of your Form DS-157 petition.

  • Employers also want to see that you have considered what it would be like to work for them. Explain what it is you like about their company (use examples if possible) and relate that to how you would fit into their working culture.
  • Remind the employer that you are keen to get the job and would like the opportunity to discuss that matter further.
  • Don’t send off your architecture cover letter before properly proofreading it. Typos and mistakes are likely to get your cover letter rejected on a technicality and not based on your actual skills. If possible get another person to read it over as well.

23.1 Cover Letters for Affirmative Applications

23.1.1 cover letter for “barebones submission”.

If you are submitting an affirmative application, as discussed in Chapter 14, it is advisable to submit the I-589 almost completely by itself, with other documentation to follow later, so as to get your client, as soon as possible, a spot in the long line for an asylum interview. The cover letter for this “barebones” application may look as follows:

23.1.2 Cover Letter for Supplemental Submissions

After submitting a barebones application, and up to one week before the scheduled asylum interview, you can submit additional documentation in support of the client’s application (see Chapters 14–22). NOTE that these submissions should go directly to the Asylum Office with jurisdiction over the client’s claim, not to the Service Center to which you previously sent the barebones application. 23.2 Cover Letters for Defensive Applications

23.2.1 cover letter for i-589 filing.

Usually, Form I-589 is submitted in open court at a Master Calendar Hearing (MCH). If, however, your first MCH is scheduled more than a year after your client’s most recent entry to the U.S., you will likely wish to file the I-589 within that first year (or as soon as possible thereafter), by mail or in person. This procedure is described in a 2016 memorandum from the Chief Immigration Judge, available at  http://www.justice.gov/sites/default/files/pages/attachments/2016/09/14/oppm_16-01.pdf . If you hand-deliver it, bring an extra copy with you to be date-stamped for your records. If you mail it, include an extra copy and a self-addressed, stamped envelope for return service of a date-stamped version, and a short cover letter (which does not and should not replace the immigration court’s own formatting and filing requirements, described in detail in the Immigration Court Practice Manual at  http://www.justice.gov/eoir/office-chief-immigration-judge-0 . Your cover letter may look as follows:

Hello everyone, I was working on my cover letter, and I had a question.

It seems like most of the cover letters I've seen are referring to the applicant or alien spouse as the beneficiary, with the petitioner being the U.S. citizen spouse, is this correct?

I'm submitting my I-485 package as a K1-Visa holder through I-129f. It seems a little strange to refer to me as the beneficiary here since everything but the Affidavit of Support is filled out personally by me.

I was going through and customized one of the templates I found a wee bit, I'd love some feedback. 😁

I wouldn't use the names Beneficiary and Petitioner.

The immigrant is now called Applicant. And the USC is the Sponsor.

The 864 and 944 is part of the 485 package. So put them together. 

I think I said before, send form 131. There's really no reason not to send it. You won't spend any more money with that. It doesn't require any specific evidence.

Fema disaster recovery center opening in wetzel county.

NEW MARTINSVILLE — A Disaster Recovery Center is opening today in Wetzel County to assist people affected by the severe storms, tornadoes, flooding, landslides and mudslides of April 2-6.

According to a release from the Federal Emergency Management Agency, Disaster Recovery Centers (DRC) serve as one-stop shops for eligible storm survivors seeking one-on-one help. Representatives from FEMA and the U.S. Small Business Administration will be at the center to answer questions.

The Wetzel County DRC will be open from 8 a.m. to 6 p.m. today through Saturday at New Martinsville United Methodist Church, 10 Howard Jeffers Drive. Future sites serving Marshall, Ohio and Wetzel counties will be announced weekly as locations are established.

People can locate the center closest to them by visiting the FEMA DRC Locator page or downloading the FEMA app to their mobile device to:

∫ Get weather alerts

∫ Subscribe to disaster safety tips

If it is not possible to visit a DRC, a toll-free telephone line is available from 7 a.m. to 11 p.m. at 800-621- FEMA (3362). People who use a relay service, such as video relay service (VRS), captioned telephone service or others, can give FEMA the number for that service.

Assistance can also be applied for online by visiting www.disasterassistance.gov.

Disaster assistance may include grants to help homeowners and renters pay for temporary housing, essential home repairs, personal property replacement and other serious disaster-related needs not covered by insurance.

SBA offers low-interest disaster loans for businesses of all sizes, homeowners, renters, and private nonprofit organizations. SBA disaster loans may cover repairs, rebuilding and the cost of replacing lost or disaster-damaged real estate and personal property.

More information about loans is available by calling SBA’s Disaster Assistance Customer Service Center at 800-659-2955, emailing [email protected] or visiting http://www.sba.gov/disaster. Applicants may also apply online via SBA’s secure website at http://www.sba.gov/disaster. People who are deaf, hard of hearing or have a speech disability are asked to dial 711 to access telecommunications relay services.
