human rights , rights that belong to an individual or group of individuals simply for being human, or as a consequence of inherent human vulnerability, or because they are requisite to the possibility of a just society. Whatever their theoretical justification, human rights refer to a wide continuum of values or capabilities thought to enhance human agency or protect human interests and declared to be universal in character, in some sense equally claimed for all human beings, present and future.

It is a common observation that human beings everywhere require the realization of diverse values or capabilities to ensure their individual and collective well-being. It also is a common observation that this requirement—whether conceived or expressed as a moral or a legal demand—is often painfully frustrated by social as well as natural forces, resulting in exploitation, oppression, persecution, and other forms of deprivation. Deeply rooted in these twin observations are the beginnings of what today are called “human rights” and the national and international legal processes associated with them.

Historical development

The expression human rights is relatively new, having come into everyday parlance only since World War II , the founding of the United Nations in 1945, and the adoption by the UN General Assembly of the Universal Declaration of Human Rights in 1948. It replaced the phrase natural rights, which fell into disfavour in the 19th century in part because the concept of natural law (to which it was intimately linked) had become controversial with the rise of legal positivism . Legal positivism rejected the theory, long espoused by the Roman Catholic Church , that law must be moral to be law. The term human rights also replaced the later phrase the rights of Man, which was not universally understood to include the rights of women.

Most students of human rights trace the origins of the concept of human rights to ancient Greece and Rome , where it was closely tied to the doctrines of the Stoics , who held that human conduct should be judged according to, and brought into harmony with, the law of nature . A classic example of this view is given in Sophocles ’ play Antigone , in which the title character, upon being reproached by King Creon for defying his command not to bury her slain brother, asserted that she acted in accordance with the immutable laws of the gods.

In part because Stoicism played a key role in its formation and spread, Roman law similarly allowed for the existence of a natural law and with it—pursuant to the jus gentium (“law of nations”)—certain universal rights that extended beyond the rights of citizenship. According to the Roman jurist Ulpian , for example, natural law was that which nature, not the state, assures to all human beings, Roman citizens or not.

It was not until after the Middle Ages , however, that natural law became associated with natural rights. In Greco-Roman and medieval times, doctrines of natural law concerned mainly the duties, rather than the rights, of “Man.” Moreover, as evidenced in the writings of Aristotle and St. Thomas Aquinas , these doctrines recognized the legitimacy of slavery and serfdom and, in so doing, excluded perhaps the most important ideas of human rights as they are understood today—freedom (or liberty) and equality .

The conception of human rights as natural rights (as opposed to a classical natural order of obligation) was made possible by certain basic societal changes, which took place gradually beginning with the decline of European feudalism from about the 13th century and continuing through the Renaissance to the Peace of Westphalia (1648). During this period, resistance to religious intolerance and political and economic bondage; the evident failure of rulers to meet their obligations under natural law; and the unprecedented commitment to individual expression and worldly experience that was characteristic of the Renaissance all combined to shift the conception of natural law from duties to rights. The teachings of Aquinas and Hugo Grotius on the European continent, the Magna Carta (1215) and its companion Charter of the Forests (1217), the Petition of Right (1628), and the English Bill of Rights (1689) in England were signs of this change. Each testified to the increasingly popular view that human beings are endowed with certain eternal and inalienable rights that never were renounced when humankind “contracted” to enter the social order from the natural order and never were diminished by the claim of the “ divine right of kings .”

About the Subject: Human rights occupy an extremely important place in contemporary discussions about law, justice and politics at both the domestic and the international level. Across all spheres of government, bodies of law and, pretty much, in every single social mobilization, human rights are invoked and debated. Just pay attention to the legal arguments underpinning or being mobilized in the news tonight. From access to drinking water and the protection of environmental resources in developed and developing countries, to contestations about the importance of more direct forms of citizens’ participation in the running of national and international affairs, to the challenging of gender stereotypes across the world, to battles around how to create a less unequal world, human rights have become an important language to advance all sorts of agendas. In doing so, human rights have become the horizon of what’s desirable and, at the same time, of what seems possible today. As such, human rights are giving a particular shape to our individual and collectives lives. This module approaches this key place occupied by human rights in the contemporary world from an international perspective. In placing our focus at the international level, the module aims to link the international human rights norms and human rights systems, with the actual practice and operation of human rights across the globe. Particular attention is paid in the module to the value, as well as the limits of human rights when they approach, or try to address the problems and the aspirations of six important ‘subjects’ – ‘subjects’ (human and non-human) which human rights have themselves helped to constitute in their current form: the Citizen, the Corporation, the Refugee, the Woman, the Non-Human Entity, and the Poor. The module is organized around lectures and seminars delivered by the convenor, as well as lectures given by invited guest speaker. Guest speakers are Kent Law School and external scholars with expertise in different areas of human rights. They will explore in their lectures how they have approached in their research and practice the six ‘subjects’ mentioned above (i.e. the Citizen, the Corporation, the Refugee, the Woman, the Non-Human Entity, and the Poor). The objective of inviting guest speakers to the module is to give you the opportunity to gain in-depth knowledge of different areas of human rights (in particular in terms of how human rights come to deal with the needs of specific subjects), and to familiarize you with different ways to think, theorize and use human rights today.

Since the end of the Cold War, the human rights agenda has been playing a significant role in shaping the foreign policies of powerful states, such as the United States and western European countries; the domestic political behavior of ruling elites in the Global South; and the agenda of global governance institutions, such as the United Nations. Despite the growing importance of human rights, incidents of violent conflict persist, especially within many states in the developing world. In most of these incidents—civil war, riots, violent protests, and so on—human rights abuses were being perpetrated by either state agents or nonstate armed actors. What explains the emergence of human rights violations? Why do states comply with human rights norms? This entry provides an analytical summary of contemporary social science research on the causes of human rights violations and outlines various important pathways and tools in which stronger human rights protection can be achieved.

What Are Human Rights?

Human rights are rights inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion, or any other status. Human rights include the right to life and liberty, freedom from slavery and torture, freedom of opinion and expression, the right to work and education, and many more.  Everyone is entitled to these rights, without discrimination.

International Human Rights Law

International human rights law  lays down the obligations of Governments to act in certain ways or to refrain from certain acts, in order to promote and protect human rights and fundamental freedoms of individuals or groups.

One of the great achievements of the United Nations is the creation of a comprehensive body of human rights law—a universal and internationally protected code to which all nations can subscribe and all people aspire. The United Nations has defined a broad range of internationally accepted rights, including civil, cultural, economic, political and social rights. It has also established mechanisms to promote and protect these rights and to assist states in carrying out their responsibilities.

The foundations of this body of law are the  Charter  of the United Nations and the Universal Declaration of Human Rights , adopted by the General Assembly in 1945 and 1948, respectively.  Since then, the United Nations has gradually expanded human rights law to encompass specific standards for women, children, persons with disabilities, minorities and other vulnerable groups, who now possess rights that protect them from discrimination that had long been common in many societies.

  • Universal Declaration of Human Rights

The Universal Declaration of Human Rights  (UDHR) is a milestone document in the history of human rights. Drafted by representatives with different legal and cultural backgrounds from all regions of the world, the Declaration was proclaimed by the United Nations General Assembly in Paris on 10 December 1948 by General Assembly resolution 217 A (III)  as a common standard of achievements for all peoples and all nations. It sets out, for the first time, fundamental human rights to be universally protected. Since its adoption in 1948, the UDHR has been translated into more than  500 languages  - the most translated document in the world - and has inspired the constitutions of many newly independent States and many new democracies. The UDHR, together with the  International Covenant on Civil and Political Rights  and its two  Optional Protocols  (on the complaints procedure and on the death penalty) and the International Covenant on Economic, Social and Cultural Rights and its Optional Protocol, form the so-called  International Bill of Human Rights .

Economic, social and cultural rights

The International Covenant on Economic, Social and Cultural Rights  entered into force in 1976. The Committee on Economic, Social and Cultural Rights is the body of 18  independent experts  that monitors implementation of the Covenant by its States parties. Its Optional Protocol entered into force in 2013. The human rights that the Covenant seeks to promote and protect include

  • the right to work in just and favourable conditions;
  • the right to social protection, to an adequate standard of living and to the highest attainable standards of physical and mental well-being;
  • the right to education and the enjoyment of benefits of cultural freedom and scientific progress.

Civil and political rights

The International Covenant on Civil and Political Rights  and its  First Optional Protocol  entered into force in 1976 and the  Second Optional Protocol  came into force in 1991. The Human Rights Committee monitors the implementation of this multilateral treaty and its Optional Protocols.

The Covenant deals with such rights as freedom of movement; equality before the law; the right to a fair trial and presumption of innocence; freedom of thought, conscience and religion; freedom of opinion and expression; peaceful assembly; freedom of association; participation in public affairs and elections; and protection of minority rights. It prohibits arbitrary deprivation of life; torture, cruel or degrading treatment or punishment; slavery and forced labour; arbitrary arrest or detention; arbitrary interference with privacy; war propaganda; discrimination; and advocacy of racial or religious hatred.

Human Rights Conventions

A series of international human rights treaties and other instruments adopted since 1945 have expanded the body of international human rights law. They include the  Convention on the Prevention and Punishment of the Crime of Genocide (1948) , the  International Convention on the Elimination of All Forms of Racial Discrimination (1965) , the  Convention on the Elimination of All Forms of Discrimination against Women (1979) , the  Convention on the Rights of the Child (1989)  and the  Convention on the Rights of Persons with Disabilities (2006) , among others .

Human Rights Council

The Human Rights Council , established on 15 March 2006 by the General Assembly and reporting directly to it, replaced the 60-year-old  UN Commission on Human Rights  as the key UN intergovernmental body responsible for human rights. The Council is made up of 47 State representatives and is tasked with strengthening the promotion and protection of human rights around the globe by addressing situations of human rights violations and making recommendations on them, including responding to human rights emergencies

The most innovative feature of the Human Rights Council is the  Universal Periodic Review (UPR). This unique mechanism involves a review of the human rights records of all 193 UN member states once every four years. The Review is a cooperative, state-driven process, under the auspices of the Council, which provides the opportunity for each state to present measures taken and challenges to be met to improve the human rights situation in their country and to meet their international obligations

The Review is designed to ensure universality and equality of treatment for every country and takes place during the sessions of the UPR Working Group which meets three times a year. The UPR Working Group consists of the 47 members of the Council.

Special Procedures and Investigative Bodies

The Human Rights Council also has special procedures that consist of independent human rights experts who have the mandate to report and advise on human rights from a thematic or country-specific perspective. These experts are not paid and are elected for 3-year mandates that can be extended for another three years. As of November 2023, there are 46 thematic and 14 country mandates.

Since 2006, the Council has set up various investigative bodies to look into alleged violations in specific countries. These have taken the form of fact-finding missions and commissions of inquiry. In addition, there is one thematic body, the Expert Mechanism to Advance Racial Justice and Equality in Law Enforcement

UN High Commissioner for Human Rights

The  United Nations High Commissioner for Human Rights  exercises principal responsibility for UN human rights activities. The High Commissioner is mandated to respond to serious violations of human rights and to undertake preventive action.

The Office of the High Commissioner for Human Rights (OHCHR)  is the focal point for United Nations human rights activities. It serves as the secretariat for the Human Rights Council, the treaty bodies (expert committees that monitor treaty compliance) and other UN human rights organs. It also undertakes human rights field activities.

Most of the core human rights treaties have an oversight body which is responsible for reviewing the implementation of that treaty by the countries that have ratified it.  Individuals, whose rights have been violated can file complaints directly to Committees overseeing human rights treaties.

Human Rights and the UN System

Human rights is a cross-cutting theme in all UN policies and programmes in the key areas of peace and security, development, humanitarian assistance, and economic and social affairs. As a result, virtually every UN body and specialized agency is involved to some degree in the protection of human rights. Some examples are the  right to development , which is at the core of the  Sustainable Development Goals ; the right to food, championed by the UN Food and Agriculture Organization, labour rights , defined and protected by the International Labour Organization, gender equality, which is promulgated by UN Women, the rights of children, indigenous peoples, and disabled persons

Human Rights Day  is observed every year on 10 December.

The Universal Declaration of Human Rights turns 75

On 10 December 2023, the UN System celebrated the 75th Anniversary of the Universal Declaration of Human Rights.

The OHCHR conducted a year-long commemoration, the Human Rights Initiative , during which 150 Member States, NGOs, businesses and UN entities made pledges on a wide range of human rights issues - from advancing women’s rights, and children’s rights, to commitments on climate change, and empowering people with disabilities to ensure legislative reforms.

The three main goals focus of the initiative were focused in universality, progress and engagement under the leadership of UN Human Rights, together with its partners. The 75th Anniversary culminated in a high-level event in December 2023 that announced global pledges and ideas for a vision for the future of human rights.

The Universal Declaration of Human Rights was adopted by the UN General Assembly in 1948. It states the basic rights and freedoms to which all people are entitled.

The devastation of World War II sparked an international desire for peace. It also encouraged the creation of a system of principles that could ensure the protection of basic human rights and dignity. Eleanor Roosevelt, the widow of President Franklin Delano Roosevelt, was one of the first American delegates to the United Nations. A longtime activist on behalf of minorities, women, workers, and refugees, Roosevelt became the chairperson of the UN Commission on Human Rights. She worked with a small group of representatives from countries around the world to define the most essential universal rights and establish them in an official document. On December 10, 1948, she urged the United Nations General Assembly to approve the Universal Declaration of Human Rights (UDHR):

In giving our approval to the Declaration today, it is of primary importance that we keep clearly in mind the basic character of the document. It is not a treaty; it is not an international agreement. It is not and does not purport to be a statement of law or of legal obligation. It is a Declaration of basic principles of human rights and freedoms, to be stamped with the approval of the General Assembly by formal vote of its members, and to serve as a common standard of achievement for all peoples of all nations. We stand today at the threshold of a great event both in the life of the United Nations and in the life of mankind. This Universal Declaration of Human Rights may well become the international Magna Carta of all men everywhere. We hope its proclamation by the General Assembly will be an event comparable to the proclamation of the Declaration of the Rights of Man by the French people in 1789, the adoption of the Bill of Rights by the people of the United States, and the adoption of comparable declarations at different times in other countries. At a time when there are so many issues on which we find it difficult to reach a common basis of agreement, it is a significant fact that 58 states have found such a large measure of agreement in the complex field of human rights. This must be taken as testimony of our common aspiration first voiced in the Charter of the United Nations to lift men everywhere to a higher standard of life and to a greater enjoyment of freedom. Man’s desire for peace lies behind this Declaration. The realization that the flagrant violation of human rights by Nazi and Fascist countries sowed the seeds of the last world war has supplied the impetus for the work which brings us to the moment of achievement here today. . . . This Declaration is based upon the spiritual fact that man must have freedom in which to develop his full stature and through common effort to raise the level of human dignity. We have much to do to fully achieve and to assure the rights set forth in this Declaration. But having them put before us with the moral backing of 58 nations will be a great step forward. 1

The United Nations approved the declaration, but the work of the commission was only partially done. The UDHR, in Roosevelt’s words, “would say to the peoples of the world ‘this is what we hope human rights may mean to all people in the years to come.’” The second part of the commission’s work was to be “a covenant which would be in the form of a treaty to be presented to the nations of the world.” Every nation that ratified the treaty “would then be obligated to change its laws wherever they did not conform to the points contained in the covenant.” 2 The commission thought a treaty might be worked out within the next few years, but this hope proved to be too optimistic. The work to secure human rights around the world remains an ongoing struggle.

#6. Reproductive rights in Poland

Reproductive rights are important everywhere, but things are becoming dire in Poland. The country has some of the most restrictive abortion laws in Europe thanks to the Law and Justice Party, which came to power in 2015. As things stand, nearly all abortions are effectively banned. Human rights are a set of principles concerned with equality and fairness. They recognise our freedom to make choices about our lives and develop our potential as human beings. They are about living a life free from fear, harassment or discrimination.

Human rights can broadly be defined as the basic rights that people worldwide have agreed are essential. These include the right to life, the right to a fair trial, freedom from torture and other cruel and inhuman treatment, freedom of speech, freedom of religion, and the right to health, education and an adequate standard of living. These human rights are the same for all people everywhere – men and women, young and old, rich and poor, regardless of our background, where we live, what we think or believe. These basic rights, commonly known as human rights, are recognised the world over as basic rights with which every individual is born.

In recognition of human rights, “The Universal Declaration of Human Rights was made on the 10th of December, 1948. This declaration is the basic instrument of human rights. Even though this declaration has no legal bindings and authority, it forms the basis of all laws on human rights. The necessity of formulating laws to protect human rights is now being felt all over the world. According to social thinkers, the issue of human rights became very important after World War II concluded. It is important for social stability both at the national and international levels. Wherever there is a breach of human rights, there is conflict at one level or the other.

Given the increasing importance of the subject, it becomes necessary that educational institutions recognise the subject of human rights as an independent discipline. Unfortunately, violation of human rights continues in most parts of the world. Ethnic cleansing and genocide can still be seen in several parts of the world. Large sections of the world population are deprived of the necessities of life i.e. food, shelter and security of life. Right to minimum basic needs viz. Work, health care, education and shelter are denied to them. These deprivations amount to the negation of the Universal Declaration of Human Rights.

The human right to live and exist, the right to equality, including equality before the law, non-discrimination on the grounds of religion, race, caste, sex or place of birth, and equality of opportunity in matters of employment, the right to freedom of speech and expression, assembly, association, movement, residence, the right to practice any profession or occupation, the right against exploitation, prohibiting all forms of forced labour, child labour and trafficking in human beings, the right to freedom of conscience, practice and propagation of religion and the right to legal remedies for enforcement of the above are basic human rights. These rights and freedoms are the very foundations of democracy.

Obviously, in a democracy, the people enjoy the maximum number of freedoms and rights. Besides these are political rights, which include the right to contest an election and vote freely for a candidate of one’s choice. Human rights are a benchmark of a developed and civilised society. But rights cannot exist in a vacuum. They have their corresponding duties. Rights and duties are the two aspects of the same coin.

Liberty never means license. Rights presuppose the rule of law, where everyone in the society follows a code of conduct and behaviour for the good of all. It is the sense of duty and tolerance that gives meaning to rights. Rights have their basis in the ‘live and let live’ principle. For example, my right to speech and expression involves my duty to allow others to enjoy the same freedom of speech and expression. Rights and duties are inextricably interlinked and interdependent. A perfect balance is to be maintained between the two. Whenever there is an imbalance, there is chaos.

A sense of tolerance, propriety and adjustment is a must to enjoy rights and freedom. Human life sans basic freedom and rights is meaningless. Freedom is the most precious possession without which life would become intolerable, a mere abject and slavish existence. In this context, Milton’s famous and oft-quoted lines from his Paradise Lost come to mind: “To reign is worth ambition though in hell/Better to reign in hell, than serve in heaven.”

However, liberty cannot survive without its corresponding obligations and duties. An individual is a part of society in which he enjoys certain rights and freedom only because of the fulfilment of certain duties and obligations towards others. Thus, freedom is based on mutual respect’s rights. A fine balance must be maintained between the two, or there will be anarchy and bloodshed. Therefore, human rights can best be preserved and protected in a society steeped in morality, discipline and social order.

Violation of human rights is most common in totalitarian and despotic states. In the theocratic states, there is much persecution, and violation in the name of religion and the minorities suffer the most. Even in democracies, there is widespread violation and infringement of human rights and freedom. The women, children and the weaker sections of society are victims of these transgressions and violence.

The U.N. Commission on Human Rights’ main concern is to protect and promote human rights and freedom in the world’s nations. In its various sessions held from time to time in Geneva, it adopts various measures to encourage worldwide observations of these basic human rights and freedom. It calls on its member states to furnish information regarding measures that comply with the Universal Declaration of Human Rights whenever there is a complaint of a violation of these rights. In addition, it reviews human rights situations in various countries and initiates remedial measures when required.

The U.N. Commission was much concerned and dismayed at the apartheid being practised in South Africa till recently. The Secretary-General then declared, “The United Nations cannot tolerate apartheid. It is a legalised system of racial discrimination, violating the most basic human rights in South Africa. It contradicts the letter and spirit of the United Nations Charter. That is why over the last forty years, my predecessors and I have urged the Government of South Africa to dismantle it.”

Now, although apartheid is no longer practised in that country, other forms of apartheid are being blatantly practised worldwide. For example, sex apartheid is most rampant. Women are subject to abuse and exploitation. They are not treated equally and get less pay than their male counterparts for the same jobs. In employment, promotions, possession of property etc., they are most discriminated against. Similarly, the rights of children are not observed properly. They are forced to work hard in very dangerous situations, sexually assaulted and exploited, sold and bonded for labour.

The Commission found that religious persecution, torture, summary executions without judicial trials, intolerance, slavery-like practices, kidnapping, political disappearance, etc., are being practised even in the so-called advanced countries and societies. The continued acts of extreme violence, terrorism and extremism in various parts of the world like Pakistan, India, Iraq, Afghanistan, Israel, Somalia, Algeria, Lebanon, Chile, China, and Myanmar, etc., by the governments, terrorists, religious fundamentalists, and mafia outfits, etc., is a matter of grave concern for the entire human race.

Violation of freedom and rights by terrorist groups backed by states is one of the most difficult problems society faces. For example, Pakistan has been openly collaborating with various terrorist groups, indulging in extreme violence in India and other countries. In this regard the U.N. Human Rights Commission in Geneva adopted a significant resolution, which was co-sponsored by India, focusing on gross violation of human rights perpetrated by state-backed terrorist groups.

The resolution expressed its solidarity with the victims of terrorism and proposed that a U.N. Fund for victims of terrorism be established soon. The Indian delegation recalled that according to the Vienna Declaration, terrorism is nothing but the destruction of human rights. It shows total disregard for the lives of innocent men, women and children. The delegation further argued that terrorism cannot be treated as a mere crime because it is systematic and widespread in its killing of civilians.

Violation of human rights, whether by states, terrorists, separatist groups, armed fundamentalists or extremists, is condemnable. Regardless of the motivation, such acts should be condemned categorically in all forms and manifestations, wherever and by whomever they are committed, as acts of aggression aimed at destroying human rights, fundamental freedom and democracy. The Indian delegation also underlined concerns about the growing connection between terrorist groups and the consequent commission of serious crimes. These include rape, torture, arson, looting, murder, kidnappings, blasts, and extortion, etc.

Violation of human rights and freedom gives rise to alienation, dissatisfaction, frustration and acts of terrorism. Governments run by ambitious and self-seeking people often use repressive measures and find violence and terror an effective means of control. However, state terrorism, violence, and human freedom transgressions are very dangerous strategies. This has been the background of all revolutions in the world. Whenever there is systematic and widespread state persecution and violation of human rights, rebellion and revolution have taken place. The French, American, Russian and Chinese Revolutions are glowing examples of human history.

The first war of India’s Independence in 1857 resulted from long and systematic oppression of the Indian masses. The rapidly increasing discontent, frustration and alienation with British rule gave rise to strong national feelings and demand for political privileges and rights. Ultimately the Indian people, under the leadership of Mahatma Gandhi, made the British leave India, setting the country free and independent.

Human rights and freedom ought to be preserved at all costs. Their curtailment degrades human life. The political needs of a country may reshape Human rights, but they should not be completely distorted. Tyranny, regimentation, etc., are inimical of humanity and should be resisted effectively and united. The sanctity of human values, freedom and rights must be preserved and protected. Human Rights Commissions should be established in all countries to take care of human freedom and rights. In cases of violation of human rights, affected individuals should be properly compensated, and it should be ensured that these do not take place in future.

These commissions can become effective instruments in percolating the sensitivity to human rights down to the lowest levels of governments and administrations. The formation of the National Human Rights Commission in October 1993 in India is commendable and should be followed by other countries.

International Human Rights (5010): This comprehensive class is designed to enhance understanding of both the theoretical foundations and practical application of international human rights law. It is structured to provide an in-depth exploration that combines academic theory with the realities of implementing human rights law on a global scale. The first segment of the course is dedicated to the fundamentals of human rights law. This includes an examination of the international human rights movement and the theory and origins of the international law of human rights. Students will study a range of UN treaties covering civil and political rights, economic, social, and cultural rights, as well as conventions against gender and racial discrimination, children's rights, and the prohibition of torture. The course will consider both the substantive law and the strategies for its implementation. It will critically analyze the UN institutional mechanisms for promoting human rights implementation, exploring both the root causes and the varied outcomes of these efforts--where the system has failed and where it has succeeded. Transitioning into the second half, the seminar will focus on the populations affected by international human rights law, moving from theory to the examination of current situations. This shift is aimed at applying the principles learned to contemporary issues, thus providing a comprehensive understanding of the strengths and weaknesses of the international human rights regime. By the end of this course, students will have developed a robust understanding of the concepts, mechanisms, and challenges of human rights law, and will be equipped with the analytical tools to actively engage in current debates and contribute to the field of human rights law and its implementation. Elements used in grading: Attendance, class participation, written assignments, and final paper. Advanced undergraduate and graduate students may request enrollment by sending a statement of interest to the instructor. Requests will be reviewed on a rolling basis. International Human Rights (5010): In part as a result of the rise of international human rights mechanisms in the twentieth century, conflicts over resources, privileges and power are now increasingly mediated through the lens of human rights, in terms of the protection of individual or group rights. Given that many of the most significant and complex national and international challenges today center on fundamental questions of human rights, understanding the legal regime that governs these rights is an important part of a comprehensive legal education. This course serves as an introduction to the law, theory and practice of international human rights, together with the instruments, organizations and arrangements that affect their implementation and enforcement. It will explore human rights as a philosophical and legal concept, and briefly probe differences between human rights, civil rights, and development frames. The course will then focus on the legal regime through which sovereign states have established human rights instruments and doctrine as part of positive international law, sometimes with binding domestic legal effects. We will review the foundations and history of international human rights law; the major international and regional human rights instruments and institutions; mechanisms and strategies of enforcement; and selected current issues in the field. A limited number of students have the option to write a long research paper in lieu of the final exam with consent of instructor. After the term begins, students accepted into the course can transfer from section (01) into section (02), which meets the R requirement, with consent of the instructor. International Human Rights (5010): This course offers an introduction to the theory and practice of human rights. We will examine major sources of international human rights law---including treaties, customary international law, and national law---as well as the institutions in which human rights are contested, adjudicated, and enforced. Key situses of human rights activity include multilateral organizations, like the United Nations Security Council and Human Rights Council; international, regional, and national courts and tribunals; and quasi-judicial treaty bodies, like the U.N. Committee Against Torture. This degree of jurisdictional redundancy offers an opportunity to explore questions of institutional design and interaction as well as processes of normative diffusion. The course will also consider the role of non-state actors---including non-governmental organizations, corporations, terrorist organizations, and ordinary individuals---in promoting and violating human rights. In addition to this survey of the human rights ecosystem, the course will engage some of the fundamental theoretical debates underlying the international human rights project with a focus on perennial questions of legitimacy, justiciability, compliance, and efficacy. Finally, we will explore a range of threats and challenges to the promotion of human rights---both perennial and novel---including economic under-development, terrorism, national security over-reach, patriarchy, and racism. We will read case law originating from all over the world, including the United States.
